Before us for automatic review, mandated by Article 37.071(f), V.A.C.C.P., is a conviction for capital murder under V.T.C.A. Penal Code, ? 19.03(a)(2) and sentence of death assessed pursuant to Article 37.071(e), V.A.C.C.P. The victim was a motorist who had stopped to help appellant and his three companions, stranded outside Bryan. One of those companions, James Charles Manuel, appellants co-defendant, was convicted of capital murder and received a sentence of life imprisonment. Another, Curtis Paul Harris, appellants brother, was tried separately, was convicted of capital murder, and a death sentence was assessed. His conviction was reversed by the Court, and the cause was remanded. Harris v. State, 642 S.W.2d 471 (Tex.Cr.App. 1982). The remaining companion, Valarie Rencher, a juvenile at the time, testified for the State at both trials.
